These terms and conditions apply to foreclosed homes, Land and all Real Properties owned by one or more selling entities (hereinafter ?seller? which shall include the selling entity, any parent company, subsidiaries, or affiliated companies). The Sellers of the Properties have instructed Auctioneer (hereinafter ?JITC? ?Jeremiahs International Trading Company, Inc. dba AACTV?) to auction the listed property to Prospective Purchasers who register according to the Terms and Conditions set forth below will be known as ?Bidder(s)?.

BIDDING: All Bidders are required to pre-register in order to bid during the Auction. There is no fee to register.

AGENCY: JITC/AACTV is not acting as an Agent for any Bidder/Buyer in any capacity, and is acting exclusively as the Sellers Agent in an auctioneer and marketing capacity only. There are no real estate companies representing either buyer or seller.

PAYMENT: All Real Estate is considered a ?cash transaction? and no financing is offered. The down payment can be made with Master Card, Visa, Discover, cashier?s check, or bank wire transfer.

BUYERS PREMIUM: A Ten Percent (10%) Non-Refundable Buyers Premium is in effect for all real estate purchases. (Percentage is calculated on, and added to the Winning Bid Price, which together equals the ?Total Sales Price?.)

DOWN PAYMENT: A twenty percent (20%) down payment (based on Total Sales Price) is due at the time of your winning bid. (This amount includes the 10% Buyers Premium). ATTORNEY?S FEES & VENUE: If any legal action or other proceeding is brought for the enforcement of any provision of these Terms and Conditions, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of these Terms and Conditions, JITC/AACTV shall be entitled to reasonable attorney?s fees and other costs incurred in that action or proceeding, in addition to any other relief to which it may be entitled.

The validity, interpretation, enforcement and effect of these Terms and Conditions shall be governed by the laws of the State of Florida, and the parties agree the Pinellas County, Florida shall be the venue for any lawsuit filed in connection herewith. Captions and paragraph headings are for convenience only and are not substantive provisions hereto.

ARBITRATION: Solely at JITC's discretion, JITC may require that all disputes, controversies, or differences between the parties arising out of or related to this Agreement shall be resolved through binding arbitration. If JITC elects not to use arbitration, the parties hereto agree that the provisions of the above Sections entitled Attorney Fees & Venue shall control as to the jurisdiction and venue of any legal action concerning the Agreement. If JITC requires an arbitration to resolve any disputes, controversy, or differences between the parties arising out of or related to these Terms and Conditions, the arbitration shall occur in Pinellas County Florida. Arbitration shall be conducted by a single arbitrator in accordance with the then-current commercial arbitration rules and supplementary procedures for commercial arbitration of the American Arbitration Association (AAA). Any discovery shall be conducted in accordance with the laws of the State of Florida. The arbitrator shall be selected by mutual agreement of the parties, or failing such agreement, shall be selected according to AAA rules. Judgment upon any arbitrator?s award may be entered in any court of competent jurisdiction. The parties hereby consent to such court?s jurisdiction.

SEVERABILITY: Should any provision of these Terms and Conditions for any reason be declared invalid, such a decision shall not affect the validity of the remaining provisions which shall remain in full force and effect as if these Terms and Conditions had been executed with the invalid provision eliminated.

By registering as a Bidder and placing bids on any real estate, Bidder(s) understands and agrees to these Terms and Conditions. JITC/AACTV reserves the right to update or amend its Terms and Conditions from time to time prior to Auction. JITC/AACTV may require Bidder(s) to execute new Terms and Conditions on any subsequent bids unless supersede by new Terms and Conditions. In the event of any disputes, controversies, or contradictions with any prior Terms and Conditions, the terms of the most recently signed Terms and Conditions will prevail. The Spor Mtn. range is known for its amazing beryllium deposits and world class fluorite. Fluorite, and Fluocerite are abundant and in very mineable quantities. The mines here are large, expansive with substantial history left intact due to the remote nature of the range. There are very few people that know of the area, and less people that visit it. The area has many, many old remnants of the hey-day of the district. Old trucks abound, many bits of history have been discarded along the old forgotten trails. This lode claim encompasses a full 20 acres of Rare Earth Elements and other possible minerals. There is no room for placer claims out here as you arent washing gold. Rare Earth Elements are a hot commodity with China and other offshore developments, the US is developing an infrastructure to process these REEs, which will likely exceed the prices of gold in the next few years. The claim covers all of the tailings and significant workings, including two adits, 1 blasting site and several large pits of exposed minerals. The claim is accessible by high clearance 4WD as the access road is good, but rough. Once on the claim, there are plenty of flat areas to stage equipment and setup camp. The nearest town is Delta, Utah, just 51 miles southeast of the claims. These mines were originally located in the 1930s, and were worked commercially from 1955 through 1975. The principal minerals of interest was Fluorite and Beryllium, additionally the USGS also notes Uranium. From 1944 to 1992 the Spor Mountains produced 350,000 tons of Fluorspar ore, 105,000 tons of Uranium ore, and approximately 2 million tons of Beryllium. The Green Crystal is noted as mainly a Fluorite producer, with Beryllium listed as a secondary mineral of importance. The deposit was first discovered in 1952 and was owned by Willden Fluorspar Company. The company began work in 1955. Relics on the site include old timbering, some old cans, but not much else. This is a 20 acre lode claim in the Spor Mountains of Juab County, Utah. The Green Crystal is noted as primarily a Fluorite producer. Fluorite has many industrial uses. It is used in the steelmaking process to help remove any impurities. It’s also used in making ceramic glass, enamels, and cooking utensils. It is also used in high performance telescopes and camera lenses, ornaments, and jewelry. There are two adits on the claim. The first adit is a 50 foot straight shot with some stoping near the end. The mine shows many bands and stretches of the fluorite and there is some definite gem quality stuff in here. There is no timber in this adit, and its mostly conglomerate until it intercepts a hard body of rock in the last 30 feet of tunnel. The other adit is a beautiful example of old school timbering and work. The entrance is stable and has some timbering built around it. A very nice mine that opens into a large stope inside. This stope has exposed many sections of purple and pink fluorite and what we assume to be beryllium. Outside there are numerous open pit sections where they have just exposed the fluorite and started to work it. The pits vary in size, measuring from forty (40) feet in length and thirty (30) feet in width, to well over 100' x 100'. We were also amazed to note the walls of some of the pits to be 30 feet tall or more. Description of Area: This should be a 3 star claim at least, but as the last of our REE mines, we are giving it a discount to let someone get on it. This is high desert at its best. The days are warm, usually all the way through January and February. Rain and snow vanish quickly and leave only short bursts of green from the moisture. In the summer days can be scorching, up into the low 100s, with the evenings dropping into the 70s. The area gets very little traffic so there is a lot left up here. The ores inside the mine are very easy to define and the fluorite is hard, box type formations, perfect for gem usage. The mine is set on the saddle of a low ridge; it encompasses both the Beryllium ring and the Fluorite deposits. There is plenty of room for trailers and other staging vehicles. There are remnants of two large houses and a large shaft that remains undiscovered. Its area unlike you will ever see and you will either love it or hate it. However we feel that it’s one of the more beautiful locations in the state of Utah and it will leave an impression on you either way. Once inside the mine, there are numerous stopes and large worked areas that show extensive and beautiful fluorite deposits. This should be considered a fluorite mine, but one of gem quality. As the mine works back there is no timber and the workings on the ribs show some very interesting fluorite and beryllium. There are so many samples that can be literally picked off the floor. The ribs of the mine still show many bits of minerals and veins. As the mine runs back farther, the tunnel opens up a bit more and shows the mineral sections that were worked for a profit in the 1960s. Geology of the Mines and or the claim: The USGS lists Fluorine-Fluorite as the commodity of importance. 800 tons were shipped from the open pit which measured 40' by 30' by 70' deep. Ore occurs in ore pipe 18 by 43 feet in plain view Beryllium mineralization near Spor Mountain, Utah, has been the subject of intensive investigation for the past 25 years. The beryllium district is on the west and southwest slopes of Spor Mountain. Five open-pit mines have supplied mill feed for approximately 15 years to a processing plant near Delta, Utah, owned by Brush Wellman, Inc. Bertrandite, a hydrous beryllium silicate (Be4Si2O7(OH)2) is the principal ore mined. Spor Mountain is made up chiefly of westward-tilted and intricately faulted Paleozoic sedimentary rocks which are locally intruded by volcanic rocks of Tertiary age. Tertiary volcanic rocks are divided into four parts, each underlain by an angular unconformity. Beryllium mineralization is limited to the tuff member of the Spor Mountain Formation. The beryllium tuff north of the Roadside Mine interfingers with the porphyritic rhyolite member of the Spor Mountain Formation. Vertically there are up to three beryllium ore zones in the tuff because of cyclic deposition. The beryllium tuff deposits on the southwest slopes of Spor Mountain have been partially altered by hydrothermal (epithermal) fluids to a fine-grained mixture of clay, potassium feldspar, silica minerals, and fluorite. The beryllium tuff deposits contain sizable but uneconomical concentrations of fluorite, lithium (smectite), manganese oxides, manganese carbonates, zinc, and uranium as well as many trace elements. Distinctive zones of argillic and feldspathic alteration enclose the beryllium deposits. The beryllium deposits are submicroscopic, disseminated in the tuff and concentrated in fluorite nodules. The relationship of topaz-bearing rhyolite flows in the Thomas Range to mineralized tuff established that some or perhaps all of the beryllium and uranium mineralization are younger than 6 m.y. (Lindsey 1977). There are several million tons of bertrandite ore that will average 0.60 percent to 0.70 percent BeO. Ore thickness will vary from 0 to 60 ft (18 m). Exploration by Brush Wellman in the Spor Mountain–Fish Springs Range area has discovered the presence of a ring structure. One can postulate that the ring structure is an incipient caldera formed by the collapse of a magma chamber from which the volcanics of the area were ejected. A few of the commercial applications for Beryllium Because of its unmatched combination of qualities, beryllium has become an increasingly important material for a wide range of commercial and governmental applications. Beryllium is used in the manufacture of telecommunications infrastructure equipment, computers and cellular phones. On the ocean floor, copper beryllium housings protect the electronics that allow fiber optic cables to function flawlessly. These barrel-like housings, which resist highly corrosive sea water and extreme pressures, show little deterioration even after decades of service. Battery contacts and electronic connectors in cell phones and portable electronics are made with copper beryllium alloys. The material meets stringent requirements for durability, weight savings, electrical conductivity and corrosion resistance in all extremes of weather and temperature. Copper beryllium alloys provide “spring memory” that ensures continuous, fatigue-free electrical connections through constant use, openings and closings, vibrations and accidental drops. The low electrical resistance and high thermal conductivity of beryllium-containing materials supports the convergence and miniaturization of multiple functions – phone, camera, MP3 player – into a single, lightweight, compact device. Because it is strong, stable, can handle elevated levels of heat resistance and is highly transparent to x-rays, beryllium, in thin foil form, has long been critical to the operation of medical and scientific x-ray equipment. Beryllium foil provides the window through which tissue-penetrating x-rays are focused, while maintaining the vacuum inside the x-ray tube generator. Beryllium foil remains indispensable for high-resolution medical radiography, including CT scanning and mammography. Beryllium in newer generation mammography equipment enables a lower radiation dose scan with significantly finer tumor resolution, enabling breast cancer detection at its early, most treatable stages. As imaging technology advances, beryllium continues to meet the need for x-ray tube windows with greater strength, stability, heat resistance and x-ray transparency. Beryllium’s capabilities are used in airbags, fire sprinkler systems, aircraft bushings and bearings, power steering and electronic control systems, anti-lock brakes, undersea earthquake and tsunami detection monitors, air traffic control radar and weather forecasting satellites. And from heat shields that protected NASA’s Mercury astronauts, to the orbital telescopes of tomorrow, beryllium materials have had a front seat in our nation’s extraordinary exploration of space. Spor Mountain Mining District History: Location The Spor Mountain mining district is about 35 miles northwest of the town of Delta in central Juab County. It can be reached from Delta by traveling northeast on U.S. Route 6 to State Route 174. Turn west on State Route 174 and continue northwest on the paved road for approximately 50 miles. The road becomes a well-groomed gravel road and immediately forks when it enters the district. The fluorspar and uranium mines are located to the north and the beryllium mines are located directly to the west at the fork. Production From 1944 to 1980, the district yielded 350,000 tons of fluorspar ore. Park (in preparation) reports total production of 260,000 tons of fluorspar ore from the Lost Sheep mine, the district's largest producer. Uranium production for Juab County from 1948 to 1970 was approximately 105,000 tons of uranium ore, and over 95 percent originated from the Yellow Chief mine. Beryllium ore production from 1970 to the end of 1992 was approximately 2 million tons. In 2000, over 100,000 tons of beryllium ore was mined, but in the past few years, production has been significantly less due to lack of demand and the processing of stockpiled ore. History The Spor Mountain district experienced three mining booms for three different commodities: fluorite, uranium, and beryllium. The fluorite boom began in the late 1930s and continues today. The uranium boom began in the early 1950s and lasted until the early 1960s. The beryllium boom began in the 1960s and continues today. Chad and Ray Spor discovered the district's first fluorspar (fluorite ore) in 1936 at Spot Mountain. Composed of fluoride and calcium, fluorite is chiefly used as flux in the manufacture of steel and in making hydrofluoric acid. In 1941, George Spor and his sons staked the Floride claim at Spor Mountain. Ore shipments began in 1944. Other claims were located (Fluorine Queen, Bell Hill, and Lost Sheep mines) and produced ore. Albert and Earl Willden staked the Lost Sheep claim in 1948 and began production that year. The Lost Sheep mine was still active as of 2005. It is the largest fluorite deposit in Utah and has been mined to a depth of 372 feet. In 1953, prospectors using hand-held Geiger counters discovered uranium on the east side of Spor Mountain. The Yellow Chief group claims were immediately located and shallow prospects dug. No more work was done for several years until the Topaz Uranium Company leased the claims. In 1959, the company began developing an open pit to uncover mineable ore. When mining ended in 1962, the over-all size of the pit was 1200 feet long, between 300 to 500 feet wide and 150 feet deep. In 1959, Dr. Norman William, a University of Utah geology professor, discovered beryllium in mineralized volcanic tuffs at Spot Mountain. This discovery was made by accident; a fluorspar sample was unintentionally placed near a beryllometer, a new instrument designed to detect trace amounts of beryllium. Unexpectedly, the beryllometer started clicking, indicating the presence of beryllium. News of the discovery spread throughout the west and many individuals as well as companies flocked to the area to file mining claims. The Brush Wellman Company was one of these companies. Brush Wellman, determined to be a major player in beryllium production, began acquiring properties, such as the Vitro claims in 1964. Mining began in 1968 and the construction of an off-site mill in Millard County was completed in 1969. In 1980, Brush Wellman bought the Anaconda claims and became the lone producer of beryllium in the Spot Mountain district. Today, Brush Wellman still remains the only producer of beryllium in Utah. Geology The Spor Mountain district consists of faulted and tilted Paleozoic (500 to 360 million years old) marine sedimentary rocks overlain by Tertiary (42 to 21 million years old) volcanic flows and volcanic tuffs. For millions of years, large volcanic eruptions deposited ash flow tuffs (fused volcanic ash), volcanic breccias (angular volcanic fragments fused together), and lava flows. Then, approximately 21 million years ago, volcanic eruptions and erosion of the older volcanic material deposited the Spor Mountain Formation (mainly composed of tuff, rhyolite, sandstone, and conglomerate). Mineralized fluids from an underlying magma body migrated up preexisting faults, encountered a favorable host rock (the Beryllium Tuff Member of the Spor Mountain Formation), and deposited the beryllium ore. The Beryllium Tuff is a perfect host rock because it is porous and contains carbonate fragments, which react with the mineralizing fluids to precipitate beryllium. Many of the carbonate fragments were replaced by other minerals, forming nodules having an outer rind rich in beryllium and a core containing fluorite, opal, chalcedony, manganese oxides, and other minerals. The fluorspar deposits of Spor Mountain also formed from mineralized fluids from an underlying magma source that moved up pre-existing faults. The host rocks are the Ordovician Fish Haven and Fluoride Dolomites and the Silurian Bell Hill, Harrisite, Lost Sheep and Thursday Dolomites. Many of these deposits are pipe-like in form and contain 60 to 95 percent fluorite. The uranium deposits on the east side of Spor Mountain were deposited in the volcanic tuff, sandstone, and conglomerate of the Spor Mountain Formation. These deposits were formed either by the erosion of a uranium-rich fluorite body and later concentration of uranium by ground water, or by precipitation from hydrothermal fluids rich in uranium rising up along faults and fractures. Relatively recent volcanic eruptions (8 to 6 million years ago) deposited the Topaz Mountain Rhyolite in the nearby Thomas Range. Topaz, pseudo-brookite, bixbyite, red beryl, hematite, and garnet are found in this rhyolite at Topaz Mountain in the southern Thomas Range. Mineralogy Primary ore minerals include bertrandite, fluorite, uranophane, and weeksite. Bertrandite is the primary beryllium-bearing mineral found in the Beryllium Tuff. Bertrandite cannot be seen with the naked eye and can only be identified with the aid of an x-ray microscope. The fluorite is rarely crystallized and tends to occur in earthy masses at many of the fluorspar mines. Small purple fluorite crystals have been found in some of the nodules at the Brush Well-man mines. Uranium ore from the Yellow Chief mine contains the minerals uranophane and weeksite. Uranophane is a pale to orange-yellow uranium mineral that fills pore spaces in the sandstone and coats individual sand grains. Weeksite is a yellow mineral that occurs in a limestone conglomerate above the uranophane mineralization. The Spor Mountain district is near Topaz Mountain, a wonderful area for the mineral collector where topaz, red beryl, bixbyite, pseudobrookite, garnet, and other minerals can be found. Current/Future Operations: In 2005, fluorspar is being mined on the Lost Sheep mine property. Brush Wellman continues to mine beryllium ore (which is shipped to a treatment facility in Millard County) and has 50 to 70 years of open-pit ore reserves remaining.
